Welcome to Fyxora. These Terms of Service ("Terms") govern your use of the Fyxora mobile application, website, and related services (collectively, the "Service"), operated by Ankush Gautam. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

Fyxora is a business management and CRM platform that provides tools for lead management, project and task tracking, invoicing, client portal access, team chat, AI voice agents, and 1-on-1 audio/video calling. The Service is available via mobile apps for iOS and Android and a web interface.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms. Users under 18 must use the Service under the supervision of a parent or legal guardian.

3. Accounts & Registration

To use most features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to keep it updated. You may create or join one or more company workspaces as permitted by your subscription.

4. Subscription & Billing

Fyxora offers free and paid subscription plans. The Free plan is available to individual freelancers. Paid plans (Starter, Growth, Business) are billed monthly via Razorpay or other supported payment methods.

  • Subscriptions automatically renew unless cancelled before the next billing cycle.
  • You may upgrade or downgrade your plan at any time. Prorated charges or credits may apply.
  • Failure to pay may result in restricted access to paid features.
  • All fees are exclusive of applicable taxes, including GST.

5. Free Plan

The Free plan is offered to a single user per company account. It includes unlimited leads, projects, tasks, and invoices. Additional team members, client portal features, AI agents, and HD calling require a paid plan. We reserve the right to modify Free plan limits with reasonable notice.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Send spam, phishing, or fraudulent communications.
  • Infringe on the intellectual property or privacy rights of others.
  • Upload malware, viruses, or harmful code.
  • Attempt to gain unauthorized access to any part of the Service or other users' data.
  • Use the Service in any manner that could disable, overburden, or impair our infrastructure.

We may suspend or terminate accounts that violate these rules.

7. Client Portal & Third-Party Users

You may invite clients, partners, agencies, and vendors to access your company workspace or client portal. You are responsible for the content you share and the permissions you grant. Clients and third-party users may only use the Service for the purpose you invited them.

8. AI Features & Call Transcription

Fyxora's AI features and call transcription are provided as productivity tools. We do not guarantee that AI-generated outputs are always accurate or complete. You are responsible for reviewing any AI-generated invoices, proposals, transcripts, or tasks before sharing or acting on them. Call recordings and transcripts are only created when you explicitly enable recording.

9. Intellectual Property

All rights, title, and interest in the Service, including its design, code, logos, and trademarks, are owned by Fyxora or its licensors. You retain ownership of the data you upload or create using the Service. You grant us a limited license to store, process, and display your data solely to provide the Service.

10. Data Security & Privacy

We take reasonable measures to protect your data. For details on how we collect, use, and protect personal information, please refer to our Privacy Policy.

11. Limitation of Liability

To the maximum extent permitted by law, Fyxora and its creator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, for any violation of these Terms or for other legitimate business reasons. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
